General Terms and Conditions CBShop

I. Applicability

These General Terms and Conditions apply to all offers from CBShop and to all agreements entered into with CBShop. CBShop is a trading name of Marcel van Minnen Multimedia in Overloon.
In addition to these General Terms and Conditions, additional terms and conditions may apply to certain services and/or products, if expressly stated. In the event of any conflict, the additional terms and conditions shall prevail, unless expressly stated otherwise.
Deviations from these terms and conditions are only valid if agreed in writing. In that case, the other provisions remain in full force and effect.
The buyer's general terms and conditions do not apply unless accepted in writing by CBShop.
The CBShop website is aimed at both the Netherlands and abroad.
"Buyer" means any visitor to the website or any natural person or legal entity who enters into or wishes to enter into an agreement with CBShop.
CBShop reserves the right to amend or supplement these terms and conditions from time to time.
Changes to these terms and conditions are only binding for future agreements. By using the CBShop website and/or placing an order, the buyer accepts these General Terms and Conditions.
CBShop is authorized to engage third parties in the execution of an agreement.

II. Offers and Formation of Agreements

Offers and price quotes serve as an invitation to the potential buyer to submit an offer. CBShop is not bound by these offers, unless otherwise agreed in writing.
Offers are valid while supplies last.
A personalized quote is valid for two (2) weeks, unless otherwise stated.
An offer from the buyer is deemed to have been made when:
- the buyer clearly indicates which product and/or service is desired;
- a quote has been signed by the buyer and received by CBShop;
- the buyer places an order via the website and CBShop has received it.
An agreement is concluded once CBShop confirms the order in writing or by email. CBShop reserves the right to refuse orders.
The parties expressly agree that electronic communication constitutes a valid agreement. The absence of a signature does not affect this. CBShop's electronic files are considered evidence, to the extent permitted by law.
Information, images, prices, and product specifications are displayed as accurately as possible. However, deviations cannot always be prevented and, in principle, do not entitle you to compensation or cancellation.
Images are indicative; products may vary in color or design. Obvious printing and typographical errors do not entitle you to delivery or compensation.

III. Prices

All prices are in euros and include VAT, unless otherwise stated.
Special offers are only valid during the specified promotional period.
The buyer owes the price as stated in the CBShop order confirmation. Obvious errors (e.g., typographical errors) can be corrected by CBShop even after the agreement has been concluded.
Delivery costs are not included in the price and are stated separately. Return costs are always the buyer's responsibility.
If statutory contributions (e.g., disposal contributions) apply, these will be stated separately.

IV. Payment

Payment can be made using the payment methods offered on the website and in-store.
Cash on delivery payments are no longer accepted. Bank transfers are available upon request.
Some payment methods may be subject to additional verification or credit checks.
If a payment term has been agreed upon, the buyer is automatically in default if the term is exceeded.
Late payment incurs 1.5% interest per month, with each month commencing as a full month.
All judicial and extrajudicial costs incurred by CBShop due to non-payment are the buyer's responsibility.
If payment is not received, CBShop may suspend delivery or terminate the agreement.

V. Delivery


Orders will be shipped as quickly as possible. Orders placed before 12:00 noon on a business day will generally be shipped the same day. Delivery times are indicative and are not final deadlines.

If a product is out of stock, the buyer will be informed of the expected delivery time.

Delivery will take place at the address provided by the buyer.

Risk transfers to the buyer once the order has been delivered to the specified address.

CBShop is not liable for loss or damage during transport after transfer to the carrier.

In the event of an incorrect address, the buyer is fully liable.

For deliveries to private customers, risk transfers to the products once the order has been delivered to the customer.

For business customers, risk transfers to the buyer once CBShop has transferred the order to the carrier.


VI. Right of Withdrawal


Private buyers have the right to cancel the agreement within 14 days of receipt of the order without giving any reason.

You can use the returns form on the website for cancellation, but this is not mandatory. Return costs are always the buyer's responsibility. Refunds will only be issued after receipt and inspection of the returned products.

The buyer is liable for any diminished value of returned products if they have been used beyond what is necessary to establish their nature, characteristics, or functioning.

Exceptions to the right of withdrawal:

- Products manufactured according to the buyer's specifications or clearly intended for a specific person;

- Products that cannot be returned for hygiene reasons and whose seal has been broken;

- Audio/video recordings or software whose seal has been broken after delivery.


VII. Liability and Warranty


CBShop is only liable for direct damage resulting from an attributable shortcoming, and is limited to the invoice value or, if lower, the amount paid by the insurance company.

CBShop is not liable for:

- Consequential damage, lost profits, or business interruption;

- Damage due to incorrect information provided by the buyer;

- Damage due to incorrect use of products; - Damage caused by third parties or carriers after transfer of the order.

Images and specifications are for illustrative purposes only.

The warranty is limited to the manufacturer's warranty, unless CBShop has provided an additional warranty in writing.

CBShop does not provide its own warranty, unless expressly agreed upon in writing.


VIII. Force Majeure


In the event of force majeure, CBShop may suspend or terminate the agreement without liability for damages.

Force majeure includes, but is not limited to: transport disruptions, supplier shortcomings, internet and power outages, government measures, pandemics, fire, strikes, and extreme weather conditions.

If force majeure lasts longer than 60 days, either party may terminate the agreement in writing.


IX. Applicable Law


All agreements with CBShop are exclusively governed by Dutch law.

Disputes will be submitted to the competent court in the district where CBShop is established, unless mandatory law provides otherwise.

For business customers, the court in the district where CBShop is established has exclusive jurisdiction.
