General Terms and Conditions
I Applicability
1. These General Terms and Conditions apply to all offers from CBShop and to all agreements entered into with CBShop.
CBShop is a trade name of Marcel van Minnen MulitMedia in Overloon.
2. In addition to these General Terms and Conditions, Additional Terms and Conditions may apply to certain services and/or products if expressly indicated. If there are differences between the Additional Terms and Conditions and these General Terms and Conditions, then, in principle, the provisions from the Additional Terms and Conditions apply above the General Terms and Conditions, unless otherwise specified.
3. The provisions in these General Terms and Conditions may only be deviated from if this has been expressly agreed in writing, in which case the other provisions of these conditions remain in full force.
4. If the Buyer also refers to his general terms and conditions, those conditions do not apply unless CBShop. has expressly agreed to this in writing.
5. The CBShop. website is aimed at the Netherlands and abroad.
6. "Buyer" means any visitor to the website or any natural person or legal entity that has or will have a contractual relationship of any kind with CBShop.
7. CBShop. reserves the right to change or supplement these conditions from time to time.
8. By using the CBShop. website and/or placing an order, the Buyer accepts these General Terms and Conditions as well as all other rights and obligations as stated on the website.
9. CBShop. is authorized to use third parties in the execution of an agreement with the Buyer.
II Offers and conclusion of agreements
1. Offers or price quotations must be regarded as an invitation to potential Buyers to make an offer. CBShop. is in no way bound by this, unless this has been recorded in writing and unambiguously. The acceptance of the invitation to make an offer by the potential Buyer is considered an offer and only leads to the conclusion of an agreement if the other provisions of this article have been met.
2. Offers are valid as long as stocks last.
3. A personalized offer is valid for two (2) weeks, unless a different term is stated in the offer.
4. An offer from the potential Buyer as referred to in article 2.1 is deemed to have been made in the sense of the following circumstances:
- the potential Buyer has indicated exactly which product and/or service he wishes to receive;
- a quote has been signed by the Buyer and received by CBShop. in the event that CBShop has issued a personalized offer;
- the potential Buyer has entered the data on the appropriate input screen of the website and the relevant data ("order form") has been sent to CBShop. electronically and has been received by CBShop.
5. An agreement is concluded at the moment that an order confirmation is handed over to the Buyer or, in the case that the offer was made via the website, is sent by e-mail to the e-mail address provided by the Buyer. CBShop. reserves the right to refuse an order.
6. Buyer and CBShop. expressly agree that a valid agreement is concluded by using electronic communication forms, as soon as the conditions in articles 2.4 and 2.5 have been met. In particular, the absence of a regular signature does not affect the binding force of the offer and its acceptance. The electronic files of CBShop. are, to the extent permitted by law, considered as a presumption of evidence.
7. Information, images, verbal, telephone or e-mail communications provided and specifications etc. with regard to all offers and the most important characteristics of the products are given or made as accurately as possible. However, CBShop. does not guarantee that all offers and products are fully in accordance with the information etc. provided. Deviations cannot in principle give rise to compensation and/or dissolution.
III Prices
1. All prices are expressed in Euros, in accordance with the legal regulations in this regard, and are inclusive of VAT unless otherwise stated.
2. Special offers are only valid for the period of validity as stated in that offer. This statement is printed in an advertisement or is stated on the website with regard to that special offer. These periods always correspond with each other.
3. The Buyer owes the price that CBShop. has communicated to it in its confirmation in accordance with article 2.5 of these conditions. Obvious (manipulation) errors in the price quote, such as obvious inaccuracies, can also be found after the creation
